West Virginia’s Mandatory Mediation Framework for Shared Parenting

When parents in West Virginia can’t agree on shared parenting responsibilities, family courts don’t jump straight to a contested hearing. State law requires parents to attempt mediation first, giving both parties a structured opportunity to resolve custody schedules, decision-making authority, and related parenting issues before a judge steps in.

Before mediation begins, every family court office conducts a pre-mediation screening to determine whether the case involves factors that would make joint mediation inappropriate or unsafe.

Mediation may not be required when the case involves:

• A history of domestic violence
• Child abuse or neglect
• Substance abuse
• Mental illness affecting the process
• A significant power imbalance between the parties

When none of those factors are present, mediation moves forward. One important point: the mediator has no authority to impose an outcome. The parents make the decisions. The mediator’s role is to structure the conversation, keep it productive, and help both sides move toward workable agreements.

Court-Approved Mediators & the Cost of Designated Mediation

Not everyone who calls themselves a mediator qualifies for court-referred family law cases in West Virginia. Mediators designated by the family court must appear on the state’s Court-Approved Family Court Mediator list. Qualifying requires, at minimum, a four-year degree, completion of a 40-hour approved family mediation course, and supervised co-mediations before practicing independently.

The cost of designated mediation is calculated on a sliding scale tied to the parents’ combined annual income. What Happens If Mediation Doesn’t Resolve Everything

Parents ordered into mediation are required to participate in good faith, but they aren’t required to reach a complete agreement. If some issues are resolved and others aren’t, the court takes the unresolved matters to a hearing. What’s said during mediation generally stays there: those communications are confidential and aren’t admissible if the case proceeds to litigation.

For families who do reach agreement, mediation produces a written document that forms the basis for a court-approved parenting plan. Because both parents had a hand in shaping it, compliance can be stronger than with a purely court-imposed order. That matters for the long-term co-parenting relationship, not just the immediate dispute.
